MEMBERSHIP AND TERMS OF USE AGREEMENT
This Membership and Terms of Use Agreement ("Agreement") sets forth the terms and conditions of your Crystal’s Drawers membership and use of the Crystal’s Drawers Web site. By signing up for a Crystal’s Drawers membership and using the Crystal’s Drawers Web site you agree to be bound by the terms of this Agreement.
1. Membership Levels.
Crystal’s Drawers reminder service reminds members of preset holidays and custom dates in accordance with the terms and conditions set forth in this Agreement. The levels of Crystal’s Drawers Reminder Service membership, benefits and the cost for each level are as set forth from time to time on the website and are subject to alteration, change, modification or cancellation without notice. A member may upgrade at anytime to the next higher level for the difference between the membership levels they are at and the level desired.
2. Membership Term and Billing.
(a) Membership Rates. The rates as published on the website for membership are the rates currently applicable for membership. These rates are for one year. In the event the rates or levels change, are altered, modified or amended the rate you paid will remain in effect for the balance of your membership period. If a Crystal’s Drawers membership level is eliminated or the benefits are modified to provide less than you signed up for, your level will automatically be upgraded for no charge for the balance of your membership period.
(b) Initial Term. The initial membership period for all membership levels will commence on the date you sign up for your membership and will terminate 1 year or 12 months thereafter ("Initial Term").
(c) Automatic Renewal. For your convenience, your Crystal’s Drawers membership will be automatically renewed on a yearly basis at the same yearly rate (unless you change your account or membership level) unless and until you cancel or we terminate you. We will continue to bill the applicable yearly membership fee to the Account you provide to us during sign up (or to a different Account if you change your account information). Your membership will automatically renew for successive yearly membership periods, without prior notice to you, unless and until you cancel your membership or we terminate it.
(d) Cancellation. You can cancel your membership at any time to avoid future billing and your membership will terminate at the end of the then-current membership period. You must cancel your membership before the end of the Initial Term to avoid the automatic billing of yearly membership fees to your Account. Click the "My Drawer" button located on the Home link of the Crystal’s Drawers Web site or access the F&Q link for cancellation instructions. We do not provide refunds or credits for any partial membership periods.
(e) Billing. You agree that during your membership term we are permitted to charge or debit, as applicable, your Account the applicable yearly membership fees and any other charges you may incur in connection with your use of Crystal’s Drawers. The membership fees will be billed at the beginning of your membership and will be automatically renewed on a yearly basis after the Initial Term at the same yearly rate (unless you change your account or membership level) unless and until you cancel or we terminate you. You can see the anniversary date for Crystal’s Drawers membership and for your next yearly renewal period by visiting the "My Drawer" section of the Crystal’s Drawers Web site. We will automatically bill your Account each year on the calendar day corresponding to the commencement of your Initial Term membership. In the event your membership began on a day not contained in a given month, we will bill your Account on the last day of such month. For example, if you became a member on January 31st, your Account would be billed on February 28th. We may change the fees and charges in effect, or add new fees and charges from time to time without prior notice, but this will not effect your current membership period. We will give you advance notice of these changes by email prior to your next automatic billing to the succeeding membership period. If you want to use a different Account or if there is a change in your credit card validity or expiration date, you may edit your Account information by clicking on the "My Drawer" button, available at the left of the “Home” page of the Crystal’s Drawers Web site.
(f) Account Status. You can find the specific details regarding your Crystal’s Drawers membership account at any time by clicking on the "My Drawer” link located on the Home page of the Crystal’s Drawers Web site.
3. Eligibility.
You must be 18 years of age or older to use become a Crystal’s Drawers member. Unless otherwise specified, the content on the Crystal’s Drawers Web site is for your personal and non-commercial use and we grant you a limited license to access the Crystal’s Drawers Web site for that purpose. You may not download (other than through page caching necessary for personal use), modify, copy, distribute, transmit, display, perform, reproduce, duplicate, publish, license, create derivative works from, or offer for sale any information contained on, or obtained from, the Crystal’s Drawers Web site without our express written consent. Any unauthorized use of the Crystal’s Drawers Web site or its contents will terminate the limited license granted by us.
4. Changes to Membership Terms.
Crystal’s Drawers reserves the right, from time to time, with or without notice to you, to change the terms of this Agreement, including the monthly membership fees, in our sole discretion. The most current version of this Agreement can be reviewed by clicking on the “F & Q” hyperlink located at the bottom of the pages of the Crystal’s Drawers Web site. The most current version of the Agreement will supercede all previous versions. Your use of the Crystal’s Drawers Web site after changes are made means that you agree to be bound by such changes.
6. Delivery and Return of Goods.
(a) Delivery. We ship our items via DHL or other carrier and charge you a flat service & shipping fee per sale amount at the time of shipment. This shipping fee, which is billed automatically to the Account you provide at sign up, or if not a member at purchase and covers the shipment of the item(s) to you as well as any necessary insurance. Gift wrap and expited services are extra and charged according to terms reached personally with Crystal’s Drawers.
(b) Satisfaction. We at Crystal’s Drawers want all our members and gift recipients completely satisfied. Our site and services are as unique as our members and the recipients they are purchasing for. With this in mind, we will try our best to make everyone’s shopping experience enjoyable, as easy as possible and will want to tell their friends about. If for any reason we don’t live up to this promise please email Crystal@crystalsdrawers.com, and let us know your thoughts.
(c) Returns. Crystal’s Drawers wants you to be completely satisfied with your purchases. If for any reason you are not, you must contact us within 7 days from receipt of your shipment. Simply email our customer service department at returns@crystalsdrawers.com or call us at (312) 943-2481 to obtain a return authorization number. In order to issue your return authorization number, we must have the following information:
* Your contact information (email and/or fax)
* The item number & description of the merchandise being returned.
* The original order number.
Your return authorization number will be issued via email (voicemail or fax if necessary).
